Booking Terms and Conditions
You (hereinafter the “Guest/You/Your”) will be asked to confirm your acceptance of these Booking Terms and Conditions (the “Terms and Conditions”) when you make a reservation at Domus Zamittello (or the “Hotel” as the case may be”).
These Terms and Conditions outline the rights and responsibilities that apply to you when you reserve a room directly with Domus Zamittello or through any of our digital channels, including but not limited to our website, central reservation number, mobile site, or app (the “Digital Channels”). You will be required to confirm your acceptance of these Terms and Conditions at the time of booking.
For the avoidance of any doubt, the “time of booking” shall mean the moment your reservation is successfully submitted and confirmed by our system, whether through written confirmation, booking reference, and/or receipt of payment (where applicable)(the “Reservation”).
- Reservation/s
- Booking Process: To reserve a room, please follow the instructions on our website, mobile site, or app.
- Age Requirement: You must be at least eighteen (18) years old to make a Reservation. Guests under eighteen (18) must be accompanied by an adult at Domus Zamittello. A valid identification documentation, such as an Identity Card or Passport, shall be requested upon check-in for the purposes of ensuring your age and personal details required for the Reservation. This is required even when Guests check-in online. Failure to provide such identification when requested may result in denial of stay of any of the Guests.
- Payment Details: A valid credit card or debit card is required to secure your Reservation. We accept the following payments made via the following: Visa, MasterCard, and American Express or other. Please ensure that the expiry date of your card is later than the end of your stay. Personal cheques are not accepted.
- Accuracy of Information: Please ensure that all Reservation details are complete and accurate before confirming the Reservation on any of our Digital Channels. Domus Zamittello shall not be held liable for any delays, disruptions, inability to check in, or loss of reservation resulting from incorrect, incomplete, or misleading information provided by you at the time of booking. This includes errors in spelling, date selection, or payment processing details. Any changes required due to such inaccuracies made by any of the Guests may be subject to additional charges and availability, and we do not guarantee that corrections can be accommodated after the reservation is confirmed.
- Reservation Confirmation: Your Reservation shall be confirmed upon receipt of an automated email issued by Domus Zamittello to the email address provided by you at the time of booking. This confirmation email shall constitute formal acceptance of your reservation request and represents a binding agreement between you and Domus Zamittello for the provision of accommodation and any ancillary services expressly included in the reservation (the “contract”). The confirmation will detail the specific terms of your booking, including check-in and check-out dates, room type, number of Guests, applicable rates, and any additional services or requests acknowledged by the Hotel.
- It is your responsibility to review the confirmation email carefully upon receipt and to promptly notify us of any discrepancies or required amendments. Failure to receive or review the confirmation due to an incorrect or inaccessible email address shall not invalidate the formation of the contract or relieve you of any obligations therein.
- Service Selection: It is your sole responsibility to ensure that the accommodation, services, and any additional options selected during the booking process are appropriate for your personal needs, preferences, and intended use. Domus Zamittello shall not be held liable or otherwise accountable for any dissatisfaction, inconvenience, or perceived inadequacy arising from your selection of services that do not align with your specific requirements, whether due to personal expectations, accessibility needs, travel arrangements, or other individual circumstances.
- We strongly recommend that you review all service descriptions, room specifications, policies, and terms before finalising your Reservation. Any failure to do so shall not give rise to any right of refund, compensation, or claim against Domus Zamittello.
- Room Allocation: Kindly note that while Domus Zamittello will make every reasonable effort to accommodate specific room preferences or special requests indicated at the time of booking (such as room location, view, bed type, or accessibility features), we cannot guarantee the allocation of a particular room number or exact configuration.
- Room assignments are subject to availability at the time of check-in and may be influenced by operational requirements, maintenance needs, or changes in guest occupancy.
- Domus Zamittello reserves the right to assign a different room of the same category or of an equivalent or higher standard, where deemed necessary. The inability to fulfill a specific room request shall not constitute a breach of contract, nor shall it entitle you to any form of refund, discount, or compensation, provided that the room offered meets the general description and standard of the room category originally reserved.
- Contracting Parties: The contract is between Domus Zamittello and the Guest (jointly, the “Parties”). However, if a third party makes a reservation on behalf of the Guest, both the third party and the Guest shall be jointly and severally responsible for all obligations arising from the contract, provided the Hotel has received a corresponding statement from the third party and the Guest. For the avoidance of any doubt, any party who is a signatory to the contract shall be jointly and severally responsible for all obligations arising from the contract.
- Group Bookings: For the avoidance of doubt, “Group Bookings” shall mean such Reservations made for four (4) or more rooms and/or suites, as the case may be, with the same or similar arrival and departure dates. Guests must note that rates published online on any of our Digital Channels are not valid for Group Bookings.
- For Group Bookings made via the official website, www.domuszamittello.com, Domus Zamittello reserves the right to:
- Contact the client directly following a Group Booking request to communicate any applicable special terms, conditions, and rates that apply exclusively to group reservations. These may include, but are not limited to, different cancellation policies, deposit requirements, minimum night stays, or payment schedules (the “applicable special terms”).
- Refuse and cancel such reservations without any liability or fault on its part, if the client has not accepted Domus Zamittello’s applicable special terms.
- Exceptions to the above apply to Group Bookings made via an authorized and dedicated booking link issued by Domus Zamittello.
- Complaints: For complaints, concerns or other issues in connection with Hotel Reservation/s, please contact Domus Zamittello directly. If any complaint, concern or other issue related to Hotel Reservation/s cannot be resolved during the stay, formal complaints should be submitted no later than seven (7) days from the date in which the Guests check-out. All complaints, concerns or other issues in this regard must be sent via email to info@domuszamittello.com
- Claims: Any claims against the Hotel shall be time-barred in accordance with applicable laws and regulations as provided under the laws of Malta.
2. Rates & Payments
2.1 Room rates are quoted per room, per night, and include breakfast as well as Value Added Tax (VAT) at the applicable rate in effect at the time of booking. The rates exclude the environmental contribution (ECO) Tax, which is charged at fifty euro cents (€0.50) per person per day, up to a maximum of five Euro (€5) per person per stay. In the event of a change in the applicable VAT rate between the time of Reservation and the date of your stay, Domus Zamittello reserves the right to adjust the VAT portion accordingly. This notwithstanding, the total payable by you for your Reservation shall remain unchanged.
- Kindly note that meals, beverages, alcoholic drinks, and other ancillary services are not included in the room rate. These items may be selected and added during the booking process or purchased separately during your stay.
3. Cancellation & No Show Policy
- Unless otherwise stated, room bookings may be cancelled free of charge up to two o’clock (14:00) local time, five (5) days prior to the scheduled arrival date. In the event of cancellation within this permitted period and where prepayment has been made in advance by debit card or credit card, a full refund will be processed to the same card on the next working day. Please be advised that the time required for the refunded amount to appear in your account may vary depending on your card issuer or financial institution. A cancellation reference number will be provided upon successful cancellation and Guests are advised to retain such reference as proof and confirmation of the cancellation.
- If you cancel within five (5) days of the scheduled check-in time or fail to arrive at Domus Zamittello on the date of the Reservation (“No Show”), a cancellation fee equivalent to the full value of the stay will be charged. This fee will include the total cost of the reserved accommodation, as well as any meals or additional extras booked. Once the free cancellation period has passed, the entire reservation becomes fully non-refundable, and nontransferable including all associated meals and additional extras. This cancellation fee serves as compensation for the late notice and does not constitute a charge for any service rendered.
- If you have made a Group Booking, specific cancellation terms will be outlined in your Reservation/ Group Agreement details.
- If Domus Zamittello cancels your reservation due to a breach of contract on your part, we reserve our legal rights and remedies available under applicable law in respect of such breach. Where your stay has not yet commenced, any payment already made or contractually due in respect of the reservation shall be retained and treated as a cancellation charge. This amount shall not be construed as payment for accommodation or services, but as liquidated damages arising from your failure to fulfil the terms of the contract. This cancellation charge shall moreover not entitle you to any claim for refund, credit, or service delivery.
- Domus Zamittello reserves the right to cancel your reservation if we are unable to fulfil our contractual obligations due to events or circumstances beyond our reasonable control. Such events may include, but are not limited to, natural disasters, fire, flooding, explosion, acts of terrorism, civil unrest, governmental restrictions or regulations, outbreaks of communicable diseases, epidemics or pandemics, health and safety incidents, industrial action, failure of utility services (including electricity, water, or telecommunications), or emergency evacuations.
- In such circumstances, we will make reasonable efforts to contact you as soon as practicable using the contact information provided at the time of booking. You will be offered the following options:
- If payment has already been made, we will issue a full refund of the amount paid in respect of the affected booking.
- If payment has not yet been made, you will not be required to make any payment to us in connection with the cancelled reservation.
- This cancellation shall not constitute a breach of contract by Domus Zamittello, and no further compensation, damages, or liability shall be payable for any resulting costs, inconvenience, or loss of opportunity you may incur as a result of the cancellation.
- e recommend that Guests obtain appropriate travel insurance to cover unforeseen disruptions of this nature.
- Except as expressly provided above, Domus Zamittello will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this contract that are caused by an event beyond our reasonable control. This does not affect your statutory rights.
- In the event that any of rooms booked in the Reservation are not used by the Guest, Domus Zamittello shall make reasonable efforts to mitigate its losses by reallocating the room to other Guests and may credit the Guest with any income generated therefrom.
- Guests who check out prior to the confirmed departure date stated in their reservation shall be charged for the remaining nights of the original Reservation. No refund or credit will be issued for unused nights unless otherwise agreed in writing.
- Domus Zamittello reserves the right to:
- Change or relocate your room to a different category and/or Hotel location within the same Hotel, at any time during your stay, where necessary, in cases of operational requirements, maintenance needs, health and safety concerns, or unforeseen circumstances such as overbooking. In such cases, the Hotel will make reasonable efforts to offer an equivalent or upgraded room, or suitable alternative accommodation where necessary; or
- Cancel any booking(s) due to health and safety concerns or if the Hotel is fully or partially closed.
- In the event that we are required to cancel your booking under such circumstances, we will use all reasonable endeavours to inform you in advance, using the contact information provided at the time of reservation. Any payments made will be refunded in full to the original debit or credit card used for the transaction. Please note that, depending on your card issuer or financial institution, it may take several working days for the refunded amount to be reflected in your account.
4. Registration
- On the date of the Reservation and upon arrival at Domus Zamittello, Guests may be required to complete a Hotel registration card. To facilitate this, identification will be requested whereby a scan of Passport or ID card will be taken for all Guests occupying the booked room/s. This shall also apply if you checked in online. Guests may also be asked to present the bank card which they used during the online reservation process, even if it was provided digitally.
- We have specific Internal Regulations for Guests, which you agree to adhere to during your stay. The Internal Regulations include but are not limited to Check-in and Check-out Procedures, Hotel facilities, Smoking Policy, Rules on Pets, Health and Safety, Damage or loss, Payment and Billing procedures. These Internal Regulations are provided to the Guests upon booking confirmation, upon check in, during stay, and/or in their room, as the case may be.
- Complimentary Wi-Fi access is provided for guest use during your stay. By using our network you agree not to use our computing resources for any illegal activities or for reproducing, displaying, distributing, or communicating any copyrighted content (such as texts, images, or photographs) without proper authorization from the copyright holder. All use of our services, including internet access and guest registration, is subject to our Privacy Policy as outlined in clause 5.1 to this contract, which outline your rights and responsibilities as well as how we manage and protect your personal data, and this in terms of the applicable law on GDPR in force from time to time.
5. Your information
5.1 We prioritize the safety and security of your data. We process personal data collected in connection with your use of our wireless network. For full details on how we handle your data, please refer to our Privacy Policy at https://domuszamittello.com/privacy-policy/. By making a reservation, including through any of our Digital Channels, you consent (on your own behalf and on behalf of any members in your group) to such processing of personal data in accordance with our Private Policy. You further warrant that all information provided is true, accurate and complete to the best of your knowledge.
- Occupancy
- The maximum occupancy for your assigned room must not be exceeded. We reserve the right to verify occupancy at any time. Occupancy is non-transferable.
- For the avoidance of doubt, Occupancy shall mean the number and identity of occupants in any room at any time during the stay at Domus Zamittello and as named in the Reservation.
- Unless otherwise specified in the Reservation and booking confirmation, check-in is available from two o’clock (14:00) on the agreed arrival date. Early check-in is not permitted without prior written arrangement between the Parties, and will remain subject to availability.
- On your departure date, you must vacate your room(s) by Eleven 11:00 noon unless otherwise agreed in writing. Should you fail to vacate by this time, Domus Zamittello reserves the right to charge you fifty percent (50%) of the room rate for additional use until 4:00 p.m. Following this time, meaning after 4:00 p.m., the full room rate will apply for any further additional use.
- In the event of a late checkout, the Hotel reserves the right to apply additional charges if such delay causes operational disruption or loss of income. However, you are entitled to provide evidence that no damage occurred, or that the disruption caused was minimal. Any such objections will be reviewed promptly and fairly by the Hotel.
- Guests are expected to take all reasonable steps to minimise any inconvenience, disruption, or potential damage resulting from a late departure.
- The service of a Wake-up call/s where required, necessary by any of the Parties or agreed upon prior, shall be made by our designated staff with the utmost care. Nevertheless, Domus Zamittello does not accept liability for any failure in their execution for any reason beyond its reasonable control. Similarly, while messages, mail, and merchandise deliveries are handled with due attention, Domus Zamittello cannot be held responsible for the successful or timely delivery of such items or otherwise. Upon request, and subject to applicable handling and postage fees when required, we will make every reasonable effort to forward undelivered items to the Guest.
7. Paying for your room & Extras
- If full payment for your room and any additional charges has not been made at the time of booking, the outstanding balance shall become payable on your scheduled departure date. In the event that payment is not settled by this time, Domus Zamittello reserves the right to charge the credit card or debit card provided at the time of Reservation to recover the amount due.
- Payment for your room and any additional charges not made at the time of booking can be made by the Guest/s by cash (with proof of identification) or by credit/debit card (Visa, MasterCard, American Express, or other.
- Our liability
- Domus Zamittello accepts full liability for any death and/or personal injury caused by or resulting from our negligence, or that of our employees or agents. Nothing in these Terms and Conditions shall exclude or limit our liability in such cases, nor for any fraudulent misrepresentation made by us, our employees, or agents.
- We shall not be held liable for any failure or delay in fulfilling our obligations in terms of this contract when such failure or delay is caused by events beyond our reasonable control. In the event that we breach these Terms and Conditions due to reasons within our reasonable control, our liability shall be limited solely to direct losses that are a reasonably foreseeable result of such breach at the time the agreement was entered into.
- Except where prohibited by any applicable law, Domus Zamittello shall not be liable for any indirect, incidental or consequential losses and/or damages to any Guest, including but not limited to:

- Loss of income, sales, and/or revenue;
- Loss of business, profits or contracts of any kind;
- Business interruption;
- Loss of anticipated savings;
- Loss, corruption or compromise of any type of data, including personal data of its Guests;
- Loss of reputation or goodwill; and
- Wasted management or office time.
- Where we are liable to you, except where such limitation is prohibited by applicable law, our maximum liability, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, shall in no circumstances exceed the total price of your Reservation. This limitation applies to all forms of loss or damage, including any costs, expenses, or liabilities incurred, and regardless of the nature or cause of the alleged breach. In circumstances where such limitation is not legally enforceable, our liability shall be limited to the maximum amount permitted by the applicable laws and regulations in force at the time.
- Settlement of disputes and applicable law
- If you have a dispute regarding the terms and conditions of this contract, kindly contact our Front Office team in order to agree to an amicable resolution.
- The terms and conditions of this contract, along with any non-contractual obligations arising from them, are governed by the laws of Malta.
- Any disputes related to this contract, including those concerning non-contractual obligations, will be exclusively resolved by the courts of Malta.
- Website information
- While Domus Zamittello endeavours to ensure that all information published on its official website(s) and other Digital Platforms is accurate, up to date, and complete, we do not warrant or guarantee the absolute accuracy, reliability, or completeness of such content. Accordingly, we accept no liability for any typographical errors, omissions, or inaccuracies that may occur.
- We reserve the right to amend, modify, update or cancel any arrangements, content, services, offers, or features displayed on our website(s) and other Digital Platforms without prior notice.
- Please note that, in certain instances, photographic images used on our website(s) may be of a generic or illustrative nature and are intended solely to represent the general style, ambiance, or standard of a particular room type or Hotel facility. These images may not necessarily reflect the exact configuration, furnishings, or view of the specific room or accommodation allocated during your stay.
- The content on our website(s) including, but not limited to, text, images, photographs, graphics, logos, icons, audio-visual material, and software, as well as other trademarks and trade designs of any nature, is the intellectual property of Domus Zamittello or its licensors (the “Intellectual Property”) and is protected by copyright and may not be copied, reproduced, modified, adapted, translated, stored, published, distributed, or altered or otherwise used in any form or by any means, whether electronic, mechanical, photocopying, recording or otherwise, for any commercial or non-commercial purpose without our prior written consent, and this in accordance with the applicable laws. Unauthorised use of the content may give rise to civil and/or criminal liability under the applicable legislation.
- Hyperlinks or references to third-party websites are provided solely for the convenience of the user and do not constitute an endorsement, approval, or recommendation by Domus Zamittello. We accept no responsibility or liability for the content, accuracy, legality, or availability of any external websites accessed via such links, nor for any loss or damage that may arise from your use of them. Access to and use of third-party sites is entirely at your own risk and subject to the terms and conditions of those external websites.
- Function Terms & Conditions
11.1 For the avoidance of doubt, this clause 11 shall be applicable to those Guests who are both attending a Conference, Function and/or Event at Domus Zamittello and also staying at the Hotel during the same period (the “Function”).
- Function Room Access & Setup:
Access to the designated Function Room is only permitted between seven o’clock in the morning (07:00hrs) and five o’clock in the afternoon (17:00hrs) for any form of setup and preparations in relation to the respective Function. Please note, no music is allowed inside the designated Function Room before half past nine in the morning (09:30hrs) and after half past eleven in the evening (22:30hrs.) - Visitor Access:
To ensure minimal disruption to in-house Guests, external family and friends visiting and who have not placed a Reservation with the Hotel are not permitted in any of the Guest/s Rooms. - In the case of the Function being a Wedding, any Wedding preparation/s and activities of a similar nature and leading up to and/or following the Wedding event are not allowed inside the Guest/s Rooms.
- Equipment Use in Function Rooms:
Any type of equipment which may be used for the setting up and/or dismantling of any items, decorations or other material of a similar nature for the Function, must not be used before nine o’clock in the morning (09:00hrs) in order to maintain a quiet environment for in-house Guests. Notwithstanding, during the rest of the day, noise levels must be kept low. - Guest Behaviour and Disturbances: Guests are expected to conduct themselves in a respectful manner during their stay at the Hotel. Any disruptive, abusive, threatening, or dangerous behaviour exhibited by Guests or their visitors will not be tolerated. The Hotel reserves the right to take immediate action, including but not limited to:
⦁ Requesting the Guest or visitor to cease the disruptive behaviour immediately;
⦁ Asking the Guest or visitor to leave the Hotel premises at any given time;
⦁ Reporting the incident to the relevant local authorities, if necessary.
- Damages: The Hotel also reserves the right to charge the Guest for any Damages caused by such behavior and to terminate the stay without refund. Damages may include, but are not limited to, physical damage to property, the cost of additional cleaning or repairs, loss of revenue due to the room being unavailable for other guests, and any legal or administrative expenses incurred by the Hotel. The Hotel also reserves the right to terminate the Guest’s stay immediately without refund if such behaviour occurs.
- Charges for Damages: Any Damages caused to any Function Room/s will be charged directly to the Guest responsible for the room, specifically such Guest who has made the Reservation and/or any third-party who is a signatory to the contract.
- Liability: Guests are responsible for any damage to the room(s) or hotel property (the “Hotel Property”) caused by them or any other Guests (whether accidental or intentional) during their stay. Domus Zamittello reserves the right to charge the credit card or debit card on file for the cost of repair, replacement, or deep cleaning (including, but not limited to, smoke damage, staining, or misuse of any Hotel Property). Guests will be notified of such charges in writing within a reasonable period following their departure from the Hotel.
- For the purposes of these Terms and Conditions, “Hotel Property” refers to all real and personal property owned or operated by Domus Zamittello, including but not limited to guest rooms, furnishings, fixtures, linens, electronics, keys and access cards, décor, appliances, public areas (such as lounges, corridors, and reception areas), and any equipment, materials, or items provided for Guest use during their stay.
- Breakfast Inclusion:
Room rates include breakfast only for in-house registered Guests. Additional and external Guests must pay separately for breakfast and any food or beverage consumed at the Hotel. - Food & Beverage Arrangements for Functions:
Guests are kindly advised that outside food and beverages are not permitted on the premises. All catering requirements must be coordinated in advance with the Hotel. - Pets: No animals are allowed on the premises (except service animals) during any Function and/or during any Hotel Reservation and stay.
- Lost Property: The Hotel is not responsible for any personal belongings or property left behind by guests after their stay and/ or after the Function (the “Personal Property”). Any Personal Property found will be held for a period of three (3) months from the date of the Guests’ departure from the Hotel and/or the date of the Function, whichever is earlier. After this period, the Hotel reserves the right to dispose of and/or donate any unclaimed Personal Property. Guests wishing to inquire about lost Personal Property should contact the Hotel directly within the holding period of three (3) months. If requested, the Hotel may arrange to return the Personal Property, at the Guest’s expense.
- Hotel Access: Hotel staff reserve the right to access the function area at any time, including during and after the Function, whenever deemed necessary to ensure the proper maintenance and oversight of the Hotel and its Property.
- Photography: Subject to the Client’s prior consent, the Hotel reserves the right to photograph the Function, provided that such activity does not disrupt the conduct of the Function.
- Guest Limit: The number of Guests must not exceed the Function Room’s maximum occupancy at any time. The Guest/s as organisers of the Function shall be responsible for ensuring that the Guest count remains within this limit throughout the duration of the Function. Exceeding the occupancy limit may result in the immediate termination of the Function and/or additional penalties to which the Guest in charge may be liable towards.
- Smoking: Smoking is strictly prohibited within all areas of Domus Zamittello during any Function and/or during the whole duration of the stay at the Hotel.
- Security: The Client is responsible for ensuring adequate security throughout the Function and in line with any applicable legislation from time to time.
- Alcohol Consumption: No alcohol shall be served to individuals under the applicable legal drinking age at the time of the Function. This may result in any penalties to which the Guest/s in charge may be liable towards.
- External Suppliers: The Guest/s are required to provide a complete and detailed list of all external suppliers engaged for the Function, including but not limited to caterers, florists, entertainers, and any other third-party service providers. This list must be submitted to the Hotel in advance for approval. The Hotel reserves the right to reject any suppliers who are included on its restricted or blacklisted supplier list, which may be updated periodically. The Guest/s moreover acknowledge that the approval of external suppliers is at the sole discretion of the Hotel, and any unauthorized suppliers may not be permitted to provide services on Hotel Property.
- Insurance: The Hotel maintains general liability, fire, and property insurance. However, these policies do not cover the Client’s personal property or guest-related losses/damages caused by third parties. All external suppliers contracted by the Client must have their own insurance coverage for any damages, fire, or accidents caused by their staff or equipment.
- Indemnification: The Client agrees to indemnify and hold the Hotel harmless from any liabilities, claims, or legal actions resulting from the use of the Facility during the Function.
The Hotel is not liable for damages, loss, or injuries to personnel or guests during the Function.
12. Miscellaneous
- Domus Zamittello reserves the right to modify, revise, or update the terms and conditions of this contract at any time. It is therefore your responsibility to review them prior to each Reservation. The terms and conditions applicable to your reservation will be those in effect on the date you make your booking and any modifications made after the date of your reservation shall not apply retroactively to that booking.
- These Terms and Conditions are drafted in English. If they are translated into another language, the English version shall prevail in the event of any conflict or inconsistency.
